NEW ! Local Rule 11.07 – Foreclosure Cases
New Local Rule 11.07, Foreclosure Cases, eliminates the requirement that Answers be filed for the County Treasurer, and was requested by the Prosecutor’s office. Following public comment for 30 days, it has been adopted. The proposed amendment eliminates any requirement that the County Treasurer move or plead in foreclosure cases where the only relief sought is to preserve the Treasure’s statutory right to claim unpaid taxes, penalties or other relief as the first and best lien. With modern records available electronically on government websites, pleadings by the Treasurer are generally unnecessary. Parties can readily identify probable tax claims without a formal pleading. This new Local Rule is effective on July 1, 2016.
